These terms of use (the “Terms”) constitute a legally binding contract between Bage Cloud LLC and its affiliates (“Bage Cloud LLC,” “we,” or “us”) and “you” (“Customer,” “your,” or “User”).

The Terms elucidate the permissible usage of the services provided through our platform and website(s) (main URL located at bagevm.com), encompassing all associated internet and online properties linked by Bage Cloud LLC, LLC and/or affiliated companies. Additionally, the Terms cover any software provided by Bage Cloud LLC for download or use, including on mobile devices (collectively referred to as our “App(s)”).

The collective term for these virtual properties, software, and mobile applications is the “Site.”

These Terms also govern your utilization of all the text, data, information, software, graphics, proprietary content, and other materials (referred to as “Materials”) provided by us and/or our affiliates, as well as any services offered through this Site.

Collectively, the Site, the Materials, and the services provided therein are referred to as the “Services.”

We reserve the right to modify these terms at any time, and customers will be notified of changes via the email they provided during registration.

1. Use of Services


You may use our services if you are of legal age to form a binding contract and are not prohibited by the laws of the United States or your country from receiving such services.

To access our services, you must provide current and accurate identification, contact, and other information during the registration process.

You are responsible for maintaining the confidentiality of your account information and all activities under your account.

Immediate notification to us is required for any unauthorized account use or security breaches.

We are not liable for any loss or damage resulting from your failure to provide accurate information or secure your account.

2. Acceptable Conduct


You are responsible for the actions of all users of your account and any data created, stored, or transmitted through your account while using our services.

Engaging in activities that interfere with or disrupt our services or networks is strictly prohibited.

3. Prohibited Usage


The following activities are considered prohibited usage and may result in immediate account suspension or cancellation without a refund.

Additionally, we may impose fees and/or pursue civil remedies without advance notice.

Resource Abuse


Intentional abuse of resources, such as excessive network traffic, CPU power, or disk IO, is prohibited.

Botting


TikTok botting is strictly prohibited, and account termination without a refund will occur for any usage in this manner.

Spam and Unsolicited Bulk Email


We have a zero-tolerance policy on spam, junk email, or UBE.

Customers are responsible for outbound traffic from the purchased IP space.

Failure to respond to complaints within 24 hours may result in service suspension.

Illegal Usages


Accessing other computers, networks, devices, and accounts without authorization, and the transmission, distribution, or storage of information, data, or material in violation of laws and regulations are strictly prohibited.

Proxies and VPN


Tor/Open Proxy/Anonymous Proxy usage is strictly prohibited due to the potential for illegal activities.

Other Harmful Activities


Activities that damage our operation, properties, and other customers.

Providing false information on any contract or application.

4. Invoicing and Payment


1. The payment service covers the entire service cycle of Bage Cloud and complies with this Agreement. Unless your service is terminated, Bage Cloud will delete your service after your payment cycle times out. This is an automatic process and irreversible.

2. Unless you and we have specifically negotiated and agreed in writing, the installation fee and recurring payment fee for the service you choose shall be paid together as the initial fee when ordering online, and all setup/installation fees and special setup fees will not be charged. return. The service fee needs to be paid in advance. If the service fee is not supported in time, your service may be temporarily or deleted.

3. When registering, you must select a payment method, Bage Cloud reserves the right to enter into agreements with third parties to handle all payment requests. Such third parties may impose additional terms and conditions governing payment processing. If you pay the service fees on time when they are due, Bage Cloud reserves the right to charge certain late fees to the extent permitted by law.

4. You agree to pay any taxes, including personal income tax, value-added tax or sales tax, resulting from your use of the Service. Bage Cloud is not responsible for any fees incurred by you and your financial institution as a result of your use of the Service and the use of bank checks, credit cards, insufficient funds, and any charges incurred by you and your financial institution. Bage Cloud should be paid in full and if there are additional charges due to taxes, exchange rate differences, bank charges, transfer charges, etc., you will need to pay them yourself.

5. You also agree to pay any attorneys fees, collection fees and other costs incurred by Bage Cloud. At the same time, Bage Cloud will not refund any installation fees, special setup fees, or remaining prepaid fees.

6. Once Bage Cloud starts providing services, we will no longer accept any refund requests, and will not be able to refund on the grounds that you purchased the product from the wrong region.

7. Coupons and discount codes – Bage Cloud will provide coupons and discount codes. These coupons and discount codes may only be applicable to first-time purchase customers, so when you have ordered Bage Cloud services, these discounts may not be effective. These coupons and discount codes may not be applied when you upgrade your product. Any account attempting to abuse coupons and promo codes will be suspended or deleted.

5. Refund Policy


We offer a 24-hour money-back guarantee on all products unless explicitly stated otherwise.
Each refund request is evaluated on a case by case basis - depending on the situation, no refund, full refund or partial refund will be issued.
Crypto Currency payments are non-refundable but may receive account credits as a form of refund. The account credits can be used to pay future invoices without using other payment methods.
To prevent abuse, only a client's first invoice is eligible for a refund unless stated otherwise.
Refunds might not be allowed in some cases:

  • Apparent fraud
  • Intended service abuse
  • Targeted by DDoS attacks
  • You used more than 10 GB traffic on the VM
  • You have received the product as 'service transfer' from another customer.
  • You have sent the product as 'service transfer' to another customer.
  • You already have / had abuse report or your VPS IP was listed on any blacklist, including Spamhaus, blocklist.de and all other abuse compliant/site with legitimate evidence, GFW of China, etc., by the time you requesting for a refund.
  • Renewal orders can not be refunded.
  • For promotional items, the discounted products can not be refunded unless specified otherwise while ordering.

Refunds will be issued to the original form of payment. After processing a refund, the account may be used for future orders but is not eligible for further refunds.
When all payments are refunded, the gateway transaction fee will not be refunded, please be aware of this..

6. Customer Support and Liability Boundaries


We are responsible for maintaining the health and operation of our hardware and system. However, we do not assume responsibility for programming or system administration for customer systems.

Customers should consult our staff for managed service quotes.

We do not backup customer data and are not responsible for data loss. While we continuously monitor hardware status, it is impossible to prevent hardware failure or data loss in some instances. Customers are urged to regularly backup their data.

We do not provide support for customers' customers.

7. Disclosure to Law Enforcement


This Terms of Service expressly prohibits the use of our service for illegal activities. Customers acknowledge that we may disclose customer information, including assigned IPs, account history, and usage details, to any court that sends us a valid Court Order, without further consent or notification. Additionally, we reserve the right to terminate all services outlined in this agreement.

8. Warranty Disclaimer


Your use of our services is at your sole risk. All services provided by us are offered as is, without warranty.

9. Indemnity


By agreeing to our Terms of Service, customers indemnify us for any violations resulting in loss or claims against us by third parties. This includes covering damages awarded against us, along with all associated costs and reasonable attorney's fees.

10. Entire Agreement


The Terms of Service, including any presented policies, guidelines, or amendments, constitute the entire agreement between you and us, superseding any prior agreements for the use of our services.
